Updates on the latest developments concerning the UKCA mark

In June 2022, the UK government had announced that it would allow manufacturers of AVCP System 3 construction products whose products were tested by a notified EU body before 1 January 2023 (historical data) to use them as the basis for a UKCA mark without the need for re-testing by a UK-approved body. This measure was related to the then objective of phasing out CE mark for construction products on 31 December 2022 and was the subject of legislation.

An update by the UK government on 9 December 2022 announced an extension of the recognition of CE mark for construction products in the UK until 30 June 2025. The handling of evidence already produced by a notified EU body (historical data) was not revised in this communication.

What does the latest update regarding the UKCA mark now clarify?

According to the UK authorities, it remains the same (as it was defined by the UK government before Brexit itself and before 20 June 2022) that only documentation produced by an Approved Body in the UK can be used as a basis for the UKCA mark.

This means that the use of documentation from a notified EU body (historical data or also newly created data) may only be used for the CE mark, whose coexistence phase ends on 30 June 2025, but not for a UKCA mark!

Since recognition of documentation from a notified EU body (historical data or also newly created data) by a body approved in the UK is also not permitted for this body, repeat tests with the involvement of a body approved in the UK are now required to use a UKCA mark. This requirement also applies to the production of new certificates.

However, no action will be taken by the UK government with regard to UKCA markings already carried out based on the 20 June 2022 upgrade. This information describes the current state of affairs, subject to any changes that may be made by the UK Government.
